These terms and conditions apply to the services of MamoTech, including creating websites, digital solutions, domain registration, hosting, support, maintenance and additional work.
1. General
MamoTech provides websites, digital solutions and online support to entrepreneurs, self-employed professionals, companies, organisations and, if agreed, private clients.
These terms apply to business clients and, where applicable, also to private clients. If a mandatory consumer protection rule legally overrides these terms, that mandatory rule will apply.
The content of an assignment is determined based on the pricing page, quotation, invoice, written agreement or other agreement made between MamoTech and the client.
2. What is included with a website or service
What exactly is included depends on the chosen service, quotation or agreement made.
For a standard website assignment, this may include for example:
- design and construction of the website;
- agreed pages;
- mobile display;
- basic SEO settings;
- contact options such as a form, email or WhatsApp button;
- basic technical setup;
- delivery of the website.
Only the parts listed on the pricing page, quotation or in the agreement made are included.
3. Domain, hosting, backups and support during the first year
With our website assignments, domain, hosting, basic backups, security check and basic support for the first year are included, unless agreed otherwise.
This applies to one standard domain name and normal hosting for a regular business website.
For special requirements, heavier hosting, extra domains, business email, external services or other extras, additional costs may apply. This will be discussed in advance.
4. Renewal after the first year
After the first year, the website, hosting, domain, basic support, basic backups and security check are automatically renewed annually, unless the client cancels on time.
The client can cancel the annual renewal with a notice period of at least 1 month before the end of the current annual period.
If the client does not cancel on time, the renewal is automatically continued for a new annual period and the related costs may be charged.
Unless stated otherwise or agreed in writing, the annual renewal consists of domain, hosting, basic backups, security check, basic support and a maximum of 4 small changes per year, divided into a maximum of 1 small change per quarter.
The costs for the annual renewal are communicated clearly in advance through a quotation, invoice, agreement or pricing page.
Without an active renewal, the domain, hosting, email, support or website functionalities may stop or go offline.
5. Small changes with annual renewal
Unless stated otherwise or agreed in writing, a maximum of 4 small changes per year are included with an annual renewal, divided into a maximum of 1 small change per quarter.
Examples of small changes are:
- a short text change;
- changing contact details;
- replacing an image;
- changing opening hours;
- a small adjustment on an existing page.
These small changes are intended for normal maintenance of existing content.
Unused small changes are not automatically carried over to the next year, unless agreed otherwise.
6. Additional work and larger changes
Larger changes or additional work are not automatically included in the original price or annual renewal, unless agreed otherwise.
Examples include:
- new pages;
- new features;
- extensive design changes;
- extra forms;
- payment or reservation integrations;
- multilingual extensions;
- extensive SEO campaigns;
- advertising management;
- new systems;
- custom functionalities;
- major changes outside the original assignment.
Additional work is discussed in advance and can be carried out at the standard hourly rate or based on a separate quotation.
7. What is outside the standard price
Not included as standard are, for example:
- professional photography;
- logo design;
- extensive texts;
- translations;
- advertising management;
- external software or licences;
- paid integrations;
- special hosting requirements;
- extra domains;
- business email settings;
- work that falls outside the agreed assignment.
If additional costs are needed, this will be discussed clearly in advance.
8. Payment and deposit
A deposit may be requested before the start of a project.
The remaining amount is paid according to the agreement in the quote or invoice.
Invoices must be paid within the payment term stated on the invoice. If no payment term is stated on the invoice, a payment term of 14 days applies.
A project is only fully delivered after the agreed payment has been made, unless agreed otherwise.
In the event of late payment, MamoTech will first send a payment reminder. If payment still remains outstanding, MamoTech may send a formal notice.
If payment is not made or is made late, MamoTech may temporarily suspend work, delivery, support, hosting, email or other services until the outstanding amounts have been paid.
Any statutory interest, extrajudicial collection costs and third-party costs may be charged to the client, insofar as legally permitted.
9. Delivery and feedback rounds
After the first version of the website, the client is given the opportunity to provide feedback.
The number of feedback rounds is agreed in advance or depends on the chosen service or quotation.
New wishes after approval or delivery may be considered additional work.
10. Maintenance and support
During the first year, basic support, basic backups and a basic security check are included, unless otherwise agreed in writing.
Basic support means assistance with normal questions about the website, using the system and small technical checks.
Basic support does not include unlimited work. Larger changes, new features, extra buttons, new modules, extra pages, extra integrations, extensive design changes or other work outside normal management are not included.
After the first year, maintenance and support can be continued through the annual renewal or through a separate maintenance agreement.
11. Backups and security check
MamoTech performs basic backups and security checks for websites where this is included or agreed.
Although MamoTech works carefully, it can never be guaranteed 100% that a website will always remain completely free from outages, hacks, errors or external problems.
In case of problems, MamoTech will help think along toward a suitable solution.
12. Texts, logos and images
The client is responsible for providing texts, logos, photos and other materials, unless agreed otherwise.
The client confirms that he or she has the right to use these materials.
MamoTech is not responsible for claims or problems caused by supplied content for which the client does not have the rights.
13. Responsibility for supplied content
The client remains responsible for the accuracy of information on the website.
This applies for example to:
- texts;
- prices;
- contact details;
- legal information;
- images;
- logos;
- terms and conditions;
- company information.
MamoTech is not responsible for errors, claims or legal problems that arise from content supplied by the client.
14. No guarantee of exact Google positions
MamoTech can perform basic SEO settings and provide advice on findability.
MamoTech cannot guarantee exact positions in Google or other search engines.
Search results depend on many factors outside our control, such as competition, search behaviour, content, domain history, technology and search engine algorithms.
15. External services
For services such as domain registration, hosting, email, payment providers, Google, WhatsApp, social media, external software, licences or other integrations, the terms of those external parties also apply.
MamoTech is not responsible for outages, price changes or changes in terms of external parties.
16. Cancellation of annual renewal
The annual renewal continues automatically, unless the client cancels in writing at least 1 month before the end of the current annual period.
Cancellation can be made by email to info@mamotech.nl or by another written and confirmed method.
When the client cancels on time, the renewal stops at the end of the current annual period.
The website, hosting, domain and support remain active until the end of that period, unless agreed otherwise.
After termination, hosting, email, support and website functionalities may be stopped, unless a separate agreement is made.
If the domain is managed by or through MamoTech, the client may request to transfer the domain to their own provider or account. MamoTech will reasonably cooperate with this. Any costs for transfer, migration, technical support or work by third parties are for the client’s account.
If the client already owns their own domain or manages the domain through another provider, the client remains responsible for that domain, its settings and any renewal, unless agreed otherwise in writing.
If cancellation takes place after the notice period, the renewal for the next year may already have started and the related costs may be due.
17. Consequences of cancellation
In case of cancellation, the website may go offline if the domain or hosting is no longer renewed.
If the client wants to move or transfer the website, MamoTech can support this. Costs may be charged for this.
The client is responsible for communicating a cancellation or transfer request on time.
18. Ownership and transfer
After full payment, the website content created specifically for the client belongs to the client, unless agreed otherwise.
Parts such as used systems, external software, licences, standard templates, technical modules or general working methods remain dependent on the solution used and the agreements made.
19. Liability
MamoTech works carefully on websites and digital solutions, but is not liable for indirect damage, lost revenue, loss of data, outages at external parties or problems caused by changes made outside MamoTech.
In case of problems, MamoTech will reasonably help think along toward a solution.
